Terms of Service

Please read these Terms of Service ("Terms") carefully before using the FretShed app ("the App"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
FretShed is a guitar practice tool that generates original solos based on parameters you choose, including genre, key, tempo, and speed. The App is available on iOS and macOS.
2. FretShed Pro Subscription
Certain features of the App require an active FretShed Pro subscription. The following terms apply to all subscriptions:
- Billing. Subscriptions are billed through your Apple ID account via the App Store. Prices are displayed in the app at the time of purchase.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- Cancellation. You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access until then.
- Refunds. All purchases are processed by Apple. Refund requests must be submitted directly to Apple in accordance with their refund policy.
- Price changes. We reserve the right to change subscription prices. You will be notified of any price changes in advance and will have the opportunity to cancel before the change takes effect.
3. Generated Content
Solos generated by FretShed are created algorithmically. By using the App, you acknowledge that:
- Generated content is created algorithmically and may not be unique.
- We make no representation that generated solos are free from similarity to existing compositions.
- You are responsible for how you use generated content, including any public performance or distribution.
- We do not claim ownership of solos generated through your use of the App.
4. Acceptable Use
You agree to use FretShed only for lawful, personal purposes. You must not:
- Attempt to reverse-engineer, decompile, or extract the source code of the App
- Use the App in any way that could damage, disable, or impair our servers or backend services
- Share, resell, or redistribute your subscription access to others
- Use automated tools to interact with the App's generation features
5. Fair Use Policy
Each FretShed Pro subscription includes a generation allowance of 80 solos within any 30-day period. The following terms apply:
- How it works. Each time you generate a solo, we count how many solos you have generated in the preceding 30 days. If that count has reached 80, the generation request is declined.
- How generations become available. Generations are not deducted from a fixed balance. Each generation ages out individually, 30 days after it was made. As older generations fall outside the 30-day lookback, your available count increases accordingly.
- Failed generations. If a generation fails due to a server error or other technical issue on our side, it does not count against your allowance.
- Limit reached. Once you have 80 generations within the past 30 days, solo generation will be unavailable until enough of those generations age past the 30-day mark to bring the count below 80.
- Equal application. The same generation allowance applies to all FretShed Pro subscribers regardless of billing plan.
- Changes to the allowance. We reserve the right to adjust the generation allowance at any time. We will give you reasonable notice of any change before it takes effect.
6. Intellectual Property
The FretShed app, including its design, code, branding, and non-generated content, is owned by us and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the App for personal purposes only.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that generated content will meet your expectations. Solo generation may occasionally produce unexpected results.
8. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.
9. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms. Upon termination, your licence to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will remain in effect.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of South Africa, without regard to its conflict of law provisions.
